PRIVACY POLICY
Skyservice Business Aviation Inc.
Skyservice F.B.O. Inc.

Skyservice Business Aviation Inc. and Skyservice F.B.O. Inc. (collectively or individually the “Company”) value their customers’ privacy. Accordingly, the Company has put in place policies and procedures to ensure the confidentiality of its customers’ personal information. This Privacy Policy does not apply to information which the Company collects about its employees. The collection and use of such information is governed by a separate policy.

1. Information Collected and the Reasons for its Collection

Personal and non-personal information is collected by the Company through various means.

Personal information about the Company’s customers, which is provided to the Company by its customers, includes, without limitation, the following: name, flight details, email address, telephone number and address, age, gender, nationality and, in certain cases, pertinent medical health information necessary to ensure the safety and proper care of the passenger aboard the aircraft which the Company operates. The Company may also collect personal information which identifies a customer personally when the customer sends to the Company comments, questions, suggestions or resumés. Personal information does not include information about an individual passenger’s name, title, business address or telephone number.

Personal information is collected and used in order to comply with the requirements of applicable Canadian, provincial and foreign countries’ laws, regulations, policies and decisions.

Personal information is also collected and used in order to track customer service issues, improve the Company’s service offering, fulfill customers’ requests and provide answers and solutions to customers’ queries and concerns.

Personal information may be collected and used by the Company in order to improve the content and efficiency of its website. Additionally, as a service and as a convenience, the Company’s website may contain links to other sites. While the Company tries to link only to sites that share its commitment to protecting the privacy of its customers, the Company accepts no liability or responsibility for the content of or the privacy practices of these other sites. Customers are encouraged to use caution when accessing other websites and to review the privacy policies of such other sites.

2. Consent

The disclosure of personal information to the Company implies the customer’s consent to the collection, storage and processing of such information by the Company. However, other than the uses more fully detailed in this Privacy Policy, the Company will not collect, retain, disclose or otherwise use a customer’s personal information without obtaining his or her express consent. Nonetheless, certain exceptions such as emergency situations or legal requirements may apply to the foregoing.

Subject to possible contractual restrictions or regulatory requirements, the customer may change or withdraw its consent by contacting the Company’s Privacy Officer. For administrative purposes, the Company will require that the customer provide reasonable notice for any such change or withdrawal. If contractual or regulatory requirements impose an obligation on the Company to collect certain personal information which the customer is unwilling to give, the Company may not, as a result, be able to perform its obligations to the customer.

3. Limiting Collection of Personal Information

The collection of personal information is limited to that which is necessary for the Company to provide appropriate and legally compliant services to its customers.

4. Limiting Use, Retention and Disclosure

Personal information is used, retained or disclosed only for those purposes for which it is collected. Personal information is retained only as long as necessary for the fulfilment of those purposes, as long as the customer maintains a business relationship with the Company or in order to comply with the law, whichever is longer, after which time it is destroyed, erased or made anonymous.

The Company shares, on a “need to know” basis, its customers’ personal information with its employees, contractors, consultants and other parties such as affiliates and third party companies which assist the Company in complying with its undertakings, responsibilities and obligations towards its customers. The Company tries to deal with only those contractors, consultants and other third parties who comply with privacy legislation; however, the Company makes no representation or guarantee that such parties do in fact comply with privacy legislation.

The Company also shares its customers’ personal information such as passport, travel arrangements and related information with customs and immigration authorities of countries which require it as a condition of travel to and from their jurisdictions.

The Company may also disclose its customers’ personal information to third parties who acquire all or a substantial part of the operations of the Company or any of its affiliates or subsidiaries, including by merger or acquisition, amalgamation, corporate reorganization or restructuring or a sale of assets. The Company requires, as a condition of disclosure of such information, that such third parties comply with all applicable privacy legislation.

5. Access to and Accuracy of Personal Information

The Company uses reasonable commercial efforts to ensure that a customer’s personal information is accurate. Subject to applicable legal or regulatory restrictions, a customer has the right to verify the accuracy of such personal information and to correct errors. The customer may do so by contacting the Company’s Privacy Officer. The Company’s Privacy Officer may request specific information from the customer in order to confirm his or her identity prior to granting access to personal information. The Company may also ask for documentation to support a request for any correction to or removal of personal information.

If requested, the Company will provide the customer with the names of third parties to whom it has given personal information and will endeavour, on behalf of the Customer, to have any errors in the accuracy of such information corrected.

If the requested personal information has been destroyed, erased or rendered anonymous pursuant to the Company’s record retention practices and policies, the customer will be so advised.

The Company will respond to all requests for access within thirty days or as otherwise required by law. If the Company needs to extend the time, or has to refuse the request, the Company will advise the customer of the reasons, subject to any legal or regulatory restrictions.

6. Safeguards

The Company has put in place procedures to safeguard and secure the information it collects or that it receives directly from its customers against unauthorized use, loss, misuse, alteration or disclosure. However, information provided to the Company through electronic means is not necessarily secure. Sensitive information should be provided to the Company either by mail or telephone.

Employees are instructed to use personal information in accordance with this Privacy Policy and applicable laws and regulations. Any misuse of personal information may be subject to disciplinary action.

7. Openness

A copy of this Privacy Policy is posted on the Company’s website. Hard copies may be requested from the Privacy Officer.

8. Changes to the Privacy Policy

This Privacy Policy applies to the Company and is in effect as of May 1, 2009. The Company may amend this Privacy Policy at any time. Any changes to this Privacy Policy will be effective from the date they are posted. The Company collects, retains, discloses and uses personal information in accordance with its most current Privacy Policy.

9. Challenging Compliance

If a customer or employee of the Company believes that the Company is not complying with this Privacy Policy, he or she may file a complaint with the Privacy Officer at the below address. The Company will acknowledge, record, investigate and respond to, and if found to be justified, take appropriate measures including, if necessary, amending policies and practices.

10. Privacy Officer

11. Limitation of Liabilities

This Privacy Policy does not create or confer upon any individual any rights or impose upon the Company any obligations in addition to the rights or obligations imposed by Canada’s federal and provincial privacy laws, as applicable. In the case of inconsistency between this Privacy Policy and the applicable privacy laws of the Canadian federal and provincial governments, this Privacy Policy shall be interpreted in respect of that particular situation in order to comply with the aforementioned applicable laws.
